New Measures for Foreigners' Return

The Portuguese Government has recently introduced a comprehensive package aimed at accelerating the return of foreign citizens. Legislative Challenges

Previously, a legislative proposal for this unit faced rejection in September due to opposition from various parties, including the Socialist Party and Chega, who blocked the government's efforts to reform immigration policy.

Bilateral Agreements and Legal Framework

To enhance cooperation with countries of origin, the government plans to sign bilateral agreements and expand the definition of 'country of return' to include third-party nations with which agreements exist. The focus remains on respecting the fundamental rights of individuals involved, particularly unaccompanied minors and families.

Emphasis on Voluntary Return

The priority will be on voluntary returns, offering financial incentives and professional training opportunities. A 30-day notice period will be established for voluntary departures after the irregularity is confirmed.

Coercive Returns and Detention

Coercive returns will be applied in cases of non-cooperation, flight risks, or security threats. The government asserts that these actions will respect fundamental rights, including procedural safeguards and legal assistance.

Alternatives to Detention

Alternatives to detention, such as periodic check-ins and geographical restrictions, will also be implemented. The proposal suggests extending maximum detention periods to allow for completion of procedures and eliminating initial notifications for voluntary departure.

Streamlined Decision Processes

The decision for return will be issued simultaneously with the rejection of asylum requests. This aims to expedite the process and ensure compliance with appeal deadlines.

Future Developments

The government aims to accelerate the handling of undocumented individuals in custody and enhance the capabilities of Frontex. Plans also include the construction of new temporary installation centers and the adoption of a European Return Order standard form.
