New Visa Regulations in Portugal: What You Need to Know About CPLP Citizens' Residency Rights

New Visa Regulations Promulgated by President Marcelo

This Tuesday, President Marcelo Rebelo de Sousa promulgated a decree-law establishing a new visa regime for citizens of the Community of Portuguese Language Countries (CPLP). However, he expressed "doubts about the expectations" surrounding this new immigration law.

In his official note, the President stated that despite the clear majority support in the Assembly of the Republic, he has concerns regarding the anticipated outcomes of this legal framework. The new decree modifies Law No. 23/2007, which governs the entry, stay, exit, and removal of foreigners from Portuguese territory.

The new legal framework aligns with EU Regulation 2017/2226, which aims to standardize the validity period of residence permits for CPLP member citizens. The new visa regime, which was approved by parliament on December 20, 2024, facilitates entry for CPLP citizens, allowing them to apply for a temporary residence permit upon arrival with a short-term visa.

Key Features of the New Visa Regulations

  • Eligibility for Temporary Residence: CPLP citizens can apply for a temporary residence permit if they hold a short-term visa or have legal entry into Portugal.
  • Entry for Timorese Citizens: Citizens from Timor-Leste can enter as tourists and subsequently apply for residency.
  • Visa Presentation Requirement: Other CPLP citizens must present their visas upon entry and then apply for residency.
  • Regulations for Irregular Situations: New rules set a 10 to 20-day window for individuals in irregular situations to leave Portugal voluntarily.

Although the government aimed to establish a National Unit for Foreigners and Borders within the PSP and modify the return regime for foreigners, the parliament rejected this proposal.

The new visa regime received support from the PSD and CDS/PP, abstentions from BE, Livre, IL, PS, and Chega, and opposition from PAN and PCP.
